RESULT OF MARKET CONSULTATION | PRESIDENTIAL ORDER – CHINESE COMPANIES | 5th January 2021

On 17 December 2020, Solactive AG published a Market Consultation on the US Presidential “Executive Order on Addressing the Threat from Securities Investments that Finance Communist Chinese Military Companies”; issued on November 12, 2020 (the “ORDER”). The Market Consultation aimed to collect feedback on the impact of the Order on the ability of market participants to replicate Solactive Indices containing securities affected by the ORDER (the “AFFECTED SECURITIES”) listed below. The consultation period ended on 4 January 2021. Solactive AG received a large number of valuable responses and conducted a comprehensive review of each respondent’s feedback.

Based on feedback Solactive AG comes to the conclusion that the ORDER will have a significant impact on the investment processes of global investors (both, U.S. investors and non-U.S. investors) with regard to the investability of the AFFECTED SECURITIES.

Given these concerns and in order to ensure that Solactive Indices remain investible Solactive AG has decided to delete the AFFECTED SECURITIES from Solactive Indices with effect as of (open) January 8, 2021. The removal of the AFFECTED SECURITIES will be separately announced as an extraordinary corporate action with further information on the treatment in the individually affected Solactive Indices and will be reflected in the corporate action and pro-forma files released on (open) January 8, 2021 for the affected Solactive Indices.

In addition, all securities affected by the ORDER will be listed in a separate exclusion list (the “EXCLUSION LIST”) and generally excluded from the index universe or starting universe, respectively, of all Solactive Indices and will not be eligible in any index selection. The EXCLUSION LIST is available from the Solactive website: www.solactive.com/. Any update to the EXCLUSION LIST will be separately announced.

Solactive AG has decided to delete the below AFFECTED SECURITIES from Solactive Indices with effect as of (open) January 12, 2021.

The list of AFFECTED SECURITIES only includes equity securities issued by the entities explicitly named in the ORDER, but not any subsidiaries or affiliated companies. The list of AFFECTED SECURITIES may be subject to future change following a communication released by the Office of Foreign Assets Control (OFAC) or any other relevant U.S. Authority. Any updates to the list of AFFECTED SECURITIES will be separately announced with details of the treatment in Solactive Indices. Solactive AG will continue to monitor for any updates to the list of entities named in the ORDER, further clarifications on the scope of the ORDER as it pertains to affiliates, and any other relevant matter.

For other indices, where Solactive AG is only the calculation agent and not acting as index administrator under the European Benchmarks Regulation (BMR), the index owner will be approached to decide whether the AFFECTED SECURITIES shall be removed from the relevant indices.
